Legal Removal – Intellectual Property Violation - HELP
Hi everyone,
I received an email regarding IP violation and our asins were removed. We are told: your listing was deactivated because we received a report from a rights owner that it may infringe upon their intellectual property rights which is against Amazon policies.
To reactivate your listing, please send any of the below listed documents for us to review.
Court order stating you are allowed to sell the products and hence are not violating Amazon policy.
Or: Work directly with the rights owner who reported the violation to submit a retraction. You can find the rights owner details in the deactivation notification sent for the listing.
Problems we are having are:
1. We have made multiple attempts to contact AMAZON to further understand the details of the infringement, but AMAZON representatives kept saying that no additional information could be provided. To date, we are still unclear about which part has been complained of infringement. We also attempted to contact the rights owner, but have not received any response.
Has anyone had similar experiences with handling this issue? How can we get more information to decide on the next steps?
2. If we are unable to obtain a court order nor have the right owner withdraw the complaint, what impact will it have on those asins and store?

If you cannot obtain the two possible solutions, then you store will be deactivated and funds and merchandise will be held and destroyed.

1. I have a similar experience every day.
All of the information is in the email you received notifying you of the deactivation. It has the contact information of the rights owner. Unfortunately, that is all of the information they will give you.
2. You will not be allowed to sell those ASINS again. If you get too many of those violations, your store will be suspended.

Sorry, what else do you need to know? Anything is said:
You listed a product which is infringing the IP rights of someone else. Or you try to sell a product of another brand or you did copy the product of another brand. YOU certainly know what you sell and don't need Amazon to explain you.
If you are lucky, the system lets you create a removal order to get the products back. Although, if these are branded products you sent to FBA there is a high risk that Amazon will confiscate and destroy them.

Thank you for the information provided regarding the issues impacting your account. I understand there are listings that are being pulled down due to concerns over intellectual property. The notification received indicates that the only way to proceed would be a court order or a retraction from the rights owner.
As mentioned in the thread, if you are unable to resolve the concerns through the paths available. Then, you may be unable to to proceed in the process. What steps have you taken as of now regarding this concern?
