False IP Trademark Infringement Complaint
Hello everyone,
I am a private label seller and I'm reaching out for help regarding a challenging Trademark Infringement situation with Amazon. We recently submitted an appeal under Case ID: 16635590501, disputing a complaint filed by a trademark owner who seems to be submitting infringement claims against any product that remotely resembles theirs. They allege that our product violates their trademark, even though we’ve ensured our listing doesn’t use their trademarked phrase.
Our product has several distinct differences from theirs, including different materials, a unique design, additional components, and other distinguishing features. To further address Amazon’s concerns, we even removed general words that could remotely resemble parts of their trademark—though we believe this request is unreasonable, as the trademarked term itself includes generic words. It feels like a situation where someone trademarks a phrase like “Sharp Pencil” and then files complaints against listings that simply use the words “sharp” or “pencil” separately, regardless of product differences.
We are confident that our product is unique, does not infringe on their trademark, and aligns with Amazon’s guidelines. This situation is frustrating, as we’ve taken all steps to ensure there’s no customer confusion.
