Duplicate ASIN creation policy

I was reading the Amazon's Duplicate ASIN creation policy and I'm looking for some clarification.
"Creating a new ASIN when the same product already exists in Amazon’s catalogue is prohibited and can result in your ASIN creation or selling privileges being temporarily suspended or permanently removed.
Matching your products to existing products in Amazon’s catalogue helps drive a high-quality customer experience. Matching to an existing product instead of creating a duplicate listing allows you to more fully benefit from buyer interest and traffic for that product."
Does this also imply to sellers who LIST (not create) a product that is a duplicate? If yes, what are the best practices for avoiding this? is it just through listing products by searching the EAN?

Yes, using the EAN and verifying that all the item specifics (e.g brand, manufacturer) match on the listing with the product you have.
It's important to verify the details even if the EAN matches because it's not unheard of for a seller adding the product to the catalogue to use the real EAN but put it under the wrong brand. Eventually, the bots pick up on that and it can cause issues.
It doesn't even need to be malicious, either. I added a Guns N' Roses Cap to the catalogue once, as it wasn't there already, and I got the ' wrong. At first there was no problem, but a couple of months down the line, it was flagged as the brand not matching, so the listing was suspended for suspected Trademark infringement.
