Question about brand names

I have a registered corporation in my state and want to use that for tax purposes and then sell under the company using a brand name that I do not own currently. Do I need to register that brand name with my state prior to listing on amazon? Just don't wanna do something illegal unintentionally. Brand name I would like is FIORE

Go first look on the website of the USPTO using their search. there are several "FIORE". Look if for your category it's not already "taken".

But normally you can list a new brand without having registered it in the USPTO, just be sure it doesn't exist already. And for Amazon it would be an advantage if you had the product with that brand on your website.

Amazon won't give you any protection for a state filing -- I tried.

If you want any help with infringements and so on you need to spend the cash for a USPTO actual TM.

What @Seller_rI7BZIczK8iACsays is correct about the search on the USPTO site.

Listing the brand on Amazon without the USPTO is a huge risk as far as I am concerned. If someone sees it and then files you will have to get in to spitting contest to prove you used it in commerce before they did. Thieves can doctor all sorts of records to prove they beat you and then they own it.

If you want to list under a brand name, you have 2 options.

1. Register your brand name with the USPTO (for US) and apply to Brand Registry.

2. You can apply for a Brand Approval if you decided not to list with a trademark.

However, I do advise you to go though Brand Registry as brand approvals may not give you access to tools to showcase your brand and will sometimes require sellers to go thorough the approval process again at times.
