Suspended from Belgium - New BE Rule 2024 Amazon require BE Vat or OSS

In true amazon Fashion, we were suspended from BE platform 5pm Friday Afternoon!

Basically they want us to either register VAT in BE or provide an OSS number. All our sales are on market facilitator platforms, and amazon act as facilitator. they pay us net, and we stamp their IOSS number into the EU shipments.

Apparently BE have gone Rogue!

I thouhgt the whole idea of amazon acting as facilitator removes our obligation. all our products are below 150 and B2C. We dont store inventory in EU. We have 3 EU Vat numbers, and dont want to register in every bloody EU country we sell! Thanks Brexit!

Amyone else having this issue? or an opinion?

Under the new Belgium VAT legislation, From 1 January 2024 online stores must collect a Belgian VAT registration number from sellers who are required to be tax registered in Belgium or evidence that the sellers are enrolled into Union One-Stop-Shop (OSS).

Hence, starting from January 1, 2024, all sellers who are required to be tax registered in Belgium must upload a Belgian VAT registration number or EU VAT registration number together with evidence of opting into OSS on Seller Central.

The following non-exhaustive list of activities are subject to Belgian VAT and trigger a tax registration obligation in Belgium:

* You are a seller who resides in Belgium and your domestic sales exceeds 25K euros.

* You have inventory stored in Belgium.

* You conduct Business-to-Consumer distance sales to customers in Belgium and your business is established in Europe.

* You have total distance sales from all sales channels within Europe in excess of 10,000 EUR per year.

* You are a non-EU seller conducting B2B sales to Belgium.

* You are a non-EU seller conducting sales from non-EU to Belgium in a shipment with intrinsic value greater than 150 euros.

Sellers who do not store inventory in Belgium and only conduct Business-to-Consumer distance sales to Belgian customers from inventory stored in the EU can alternatively meet their Belgian tax obligations by opting into OSS. The One-Stop Shop requires sellers to register for OSS in the country in which they have established their business and to report all EU Business-to-Consumer cross border sales under OSS.

In order to reactivate your account you need to submit the requested documents and information mentioned in above performance notification.

All Sellers on Amazon Stores are required to meet the compliance requirements stipulated by the law. VAT registration requirements vary from region to region in Europe, and you need to submit a valid VAT number in a timely manner on the Stores where the VAT obligation is generated, and make sure that the VAT number you submitted complies with the business registration name on the Seller Central. At the same time, please keep in mind your account number and password (if applicable) registered on the HMRC website to ensure that you can manage it yourself and view relevant tax materials timely.

Do you use Prime outside the EU? If so, it's possible someone bought something from your Prime, then returned it to a warehouse in Belgium, meaning you were, though no fault of your own, now storing inventory in Belgium.

I think it's more likely what Disenchanted_Seller has flagged, and I'm amazed it's the first time I'm seeing this. Looks like Belgium is coming off our shipping templates.
