Amazon Brand protection disaster

I understand Amazon's good intention to raise the level of Brand Protection, but in many cases, the results turned out to be the opposite.

I also don’t understand how the Performance team cannot notice that all these IP complaints and email addresses are fake.

An email address like:

-- novolifebrandprotection-gmail.com

serious companies do not have such an email

Now, I already have six actual cases of fake IP complaints.

For ASIN: B0C44V5MWJ , Complaint ID: 14398672561

I have LOA, original invoices, and a Certification letter.

These fake IP complaints were rejected three times. After the fourth, the Performance team started to reject my original genuine documents and claimed that the complaint came from the right owner. This can not be because I live just 12 km from the Brand owner and his factory. And I am in constant contact with them.

Last year, the same competition seller submitted 16 fake IP complaints for Siang Pure Brand. We both live in Thailand and have offered the same product many times.

I also had LOA invoices and bank transfer statements for Siang Pure Brand. After rejecting this fake IP complaint on Siang Pure Brand many times, the performance team started to reject my appeals.

Now, the same happened for the Novalife Hong Khu inhaler. After many appeals, they have blocked me from continuing to complain in this case.

For the product Hong Thai Compound Thai Herb Inhalant i got 2 Fake IP complain

Complaint ID: 14548368441 Complaint ID: 14511708451

Brand owner Thai Herbal Hongthai Co., Ltd (limited company (ltd.); THAILAND),

has the official on their website published that “No authorization individual or juristic person is given to use commercial or copyrights of Hong Thai inhalant”

The best example mentioned in the title is the Counterpain Brand.:

Mr Sakulkoo Surachai, the shop owner of” United States Official Registered Brand Owner.”(Yes, it is not a joke; he has given his shop this name 😊)

In the USPTO, he has a registered name, worth counterpain, as his brand name. The well-known Brand owner of the International company Taisho Pharmaceutical Holdings was not to much worried about the ownership of her Brand protection. They work exclusively with wholesale pharmacies that supply drugstores. There is no possibility that Wholesale pharmacies would purchase their product from unknown sources.

After registering the name Counterpain in the USPTO, Mr Sakulkoo Surachai registered this Brand as his own in the Amazon Brand registry.

Other sellers were banned for IP violations. I got 3 for three different ASINs of the same brand.

Now Amazon is claiming that company Taisho Pharmaceutical is not the brand owner of Coutrpain's product and that the owner of this brand is Mr Sakulkoo Surachai.

An individual, not a juristic person,

They don't have any authorization letter or license agreement

-don’t have any registered manufacturing facility

They are not the producer of these products

-They don't have any legal documents that they are a registered company that must comply with Thailand or USA FDA requirements.

-They don't have any FDA registration documents.

-EAN don’t belong to them

They did not design these products' symbols and packages.

All they have is a name, a word registered in USPTO, but Amazon claims they are the owners.

Seller support was contacted unsuccessfully several times.

Does anyone know how to proceed?

I understand you have made a few appeals already which were not accepted. Within the performance notification advising you of the rejection, there may be specific information as to why the document was not accepted. In most cases, the message lists either a supply chain request or a quantity mismatch. If you are not seeing specific guidance regarding either of these scenarios, this would indicate there is a problem with documents themselves. Any submissions will need to adhere to our Letter of Authorization and Invoice requirements.
