Section 3 Complaint
Hello Sellers,
I just received a Section 3 complaint on an item that I believe came from a competitor on the same listing as the product the section 3 complain came from. It was the same person who bought my item, he said that he received a pack of 1 instead of 2, (Do Not Separate stickers have been placed on them) and that they delivered late. He also left a 1 star review that amazon crossed off. Then 2 days later I received a Section 3 violation. I never had a normal customer do this before, which makes me think it was someone else on this same listing who did that. (This was an FBA Order by the way)
However, everything I sell is legitimate, I would never sell counterfeit products. But now I don't really know what to do and how to really battle this. I only have 1 Walmart invoice (Sold and Shipped by Walmart) of the product and the card it was purchased on. I hope this is enough to get by as "proper documentation". As well as my drivers license and credit statements.
If any of you have any advice on what I can do or what I should add to battle this I would greatly appreciate it.
I don't know what the success rate is to pass this violation, but I just want full access to my account back to keep providing great service to customers.

Is this really an invoice? Do you have a document with your name and address with title "INVOICE"? If not, that is a violation.
Nevertheless, you already did a violation by sending to an Amazon customer a package "Sold and Shipped by Walmart". This is a violation of the dropshipping policy and not allowed.
If Amazon didn't yet suspend your seller account you can be very happy. And no, you can not "battle this". Be prepared to receive an email from Amazon informing you about this violation and read carefully if and how you can address this violation.

Have you sourced ALL your products from Walmart or any other retailer? If so then yes, all your products are considered to be counterfeit by Amazon and you have violated Section 3 of the agreement.
Amazon will never accept the "invoice" you possess because it's not really an invoice but rather a receipt.
If you have a deactivation notice from Amazon post that. But in my opinion, you're about to lose your account if you haven't already, and you're most likely done on Amazon.
If you have a lot of product in FBA, probably best you concentrate on getting that recalled, if you are even able to. Amazon normally doesn't let sellers do that for product they've determined to be counterfeit, however, nor will they release any funds associated with said product.

No sorry, I don't have any further advice for you other than showing them invoices for your purchases, which you can't do. As I said, what you have are retail receipts, not invoices. In Amazon's opinion, you have violated Section 3 and theirs is the only one that counts.

I understand you have concerns regarding a request for documentation in order to prove the authenticity of the products you have listed for sale.
As members of the community have already touched on the invoices that are typically going to verify your supply chain, I would like to refer to the actual requirements of the documents here.
Copies of invoices, receipts or other similar documents that demonstrate where your products are produced or manufactured
These documents:
- Should reflect the sales volume of your product across all Amazon marketplaces in the last 365 days
- Should demonstrate your product’s full supply chain
- Should include contact information for the supplier(s) and the original manufacturer. We may contact suppliers or manufacturers to verify the documents
- Your documents should be able to trace your products to the original manufacturer even if you did not purchase them directly from the original manufacturer. This may require requesting additional invoices or supply chain documentation from your supplier if you are not sourcing directly from the manufacturer.
- You may remove pricing information, but the rest of the document must be visible to enable adequate review of the documents you provide. For ease of our review, you may highlight or circle the ASIN(s) under review.
Do your documents meet these requirements?
Even in the case that they do meet Amazon's requirements, this does not always mean the information will be verifiable. If so, it could be that you might need a letter of authorization or a licensing agreement for the brand in question.
Such documentation will show that you are, indeed, sourcing from a verified and authorized supplier. It is important to trace the supply chain from you, the seller, through your supplier, and back to the original brand.
