I am at such a loss. A Chinese company has created a product similar to ours and copied our label (inserting their "brand") where our trademarked brand is. I filed a violation report and have received the following message from Amazon: The description of copyrighted work doesn’t match the reported content. I don't even know how to respond. Every pantone color, design element, and logo/text placement has been copied.
To make matters worse, my listing was also pulled. I have been selling on Amazon for 5 years without incident and all of a sudden my product has been labeled a pesticide (which it is not). I'm guessing this company had something to do with it. Every time I reach out to Amazon about my inactive listing, I receive an email back saying there is no restrictions on my listing and the listing is active.
Any suggestions? I am absolutely gutted that they are allowed to do this. They are also copying the labels of another company (several products).

Often times its how you are reporting and not necessarily what you are reporting when these reports of violations are rejected. The best resource is Intellectual Property for Rights Owners help page. It is a very robust help page, but I recommend reviewing the "Main types of IP," (Copyright section) "Types of notices not accepted on Amazon," and "Reporting Infringement," sections. This will help you identify which type, what to avoid and best practices for reporting violation.

Your other issue with the product being classified as a pesticide, these types of enforcements do not typically originate from another seller. I have seen this many times and usually the root cause is a word or phrase that are considered pesticide clams such as 'Prevents, blocks, removes, neutralizes, or controls bacteria or other pests." You can find this and a lot more on the Pest control products and pesticides help page.
