Appeal Loop for Wrongful Trademark Infringement - ASIN at Risk!

Hello, fellow sellers,

I'm reaching out in a moment of need and hoping for some guidance from the community. I’ve found myself stuck in a challenging situation with Amazon over an unintentional trademark infringement issue.

Initially, I received a notification from Amazon indicating a violation of their Intellectual Property policies due to a trademarked phrase mistakenly included in our Premium A+ Content. Acting promptly, I removed the infringing term from the listing, updated the product detail page and keywords to avoid any trademark issues, and submitted an appeal through my Account Health dashboard as instructed.

Despite these corrective actions, my appeal was rejected. Amazon’s response highlighted the necessity of submitting either a letter of authorization or a licensing agreement from the rights owner. Here’s the catch: the product I sell is completely unrelated to the mistakenly mentioned trademark and does not require licensing from that trademark's owner. It's a unique product that does not infringe on anyone’s intellectual property rights.

To strengthen my case, I provided comprehensive evidence including an invoice from my manufacturer, product images clearly showing the absence of any trademark violation, a screenshot of my brand registry to confirm my brand’s legitimacy, and a detailed appeal in PDF format. Unfortunately, none of these efforts have led to a resolution. My ASIN remains in compliance with Amazon's policies, yet my appeals are met with repeated rejections, each suggesting I make changes I have already implemented.

Each rejection reiterates the advice to "modify the item’s product detail page and keywords to ensure they do not infringe on the trademark of the rights owner listed below." I've meticulously followed these instructions to no avail.

I’m at a loss and feeling the strain of this continuous loop, especially considering the clear evidence I've provided demonstrating my product’s compliance and distinctiveness. Has anyone here experienced something similar? How did you navigate this, and do you have any advice on engaging more effectively with Amazon's Seller Performance Team to get my listing reinstated?

I greatly appreciate any insight, advice, or shared experiences you can offer. Your support during this frustrating time means a lot.

Thank you all in advance for your help.

Best regards, Max

When you replaced the Premium A+ content, did you change the image itself and all associated metadata within the A+ editor? I wonder if support and/or the algorithms assume the infringing content is still there because parts of the Premium A+ content were not changed.

If I were you I would not edit the existing Premium A+ content. Delete it and make sure no other A+ content is associated with the ASIN. Ask Amazon to review. If they still reject it, you know the problem is with something else besides the A+ content.

I would then completely redo the description and detail page images, and resubmit. If you can get past this, only then would I recreate the A+ content completely from scratch - absolutely nothing from the old Premium A+ content.

Good luck.

Thank you for the information provided. I understand that you have been attempting to appeal the violation, but have been unsuccessful as of now. If the appeals are being rejected, it is going to be due to their being details or information associated that are not compliant.

Are you the ASIN creator? Have you attempted to provide evidence of any changes that were made to the listing? Have you contacted brand registry for assistance with the violation? Depending on the situation, they may be able to provide some assistance to your issue. Have they provided a response at all?

If you have any updates or questions regarding this issue, continue to refer here for support.

Best,
